Planning exemptions are currently set out in the Planning and Development Regulations 2001 as amended and the Planning and Development (Exempted Development (Act of 2000)) Regulations 2026 which came into effect on the 27th July 2026.

While some exempted development can be carried out without consulting with the local authority, certain developments will require formal notification in advance. Developments carried out having regard to Class 1A (sub-division) and Class 3A (Detached Auxillary Dwelling ‘DAD’) will require notification to the Planning Authority at least 14 days before the development takes place. Local Authorities will be required to report to the Minister for Housing, Local Government and Heritage on such developments.
