How to Get an Official Confirmation - Section 5 Declarations

If you have any doubts or queries on any planning aspect, you should contact your local planning authority as works which exceed the exemption thresholds may be subject to planning enforcement.

In order to find out whether a development requires planning permission, you can formally request a declaration under Section 5 of the Planning and Development Act 2000 as amended.  An request for a declaration should be made in writing to the planning authority, and should be accompanied by all relevant site maps and drawings.  A fee of €80 will be payable. The planner will then assess the application and make a decision within four weeks. 

If you disagree with the decision of the Planning Authority you may appeal the decision to An Coimisiún Pleanála accompanied by a fee (€220).
